1. These terms
These terms of service govern your purchase and use of FlowNest Workspace software and this website. By placing an order or using the software you agree to them. Please read them carefully and keep a copy for your records.
2. The software
FlowNest Workspace is productivity and workflow software provided on a licensed basis. The features available to you depend on the plan you purchase. Plan contents are described on our pricing page and were accurate at the time of your order.
3. Orders and acceptance
Adding a plan to your basket and completing payment constitutes an offer to purchase. Your order is accepted when we confirm it and issue your access details. If we cannot fulfil an order we will tell you promptly and refund any payment in full.
4. Prices and payment
- All prices are shown in pounds sterling and include any UK VAT that applies at the point of sale.
- Payment is taken at checkout through Stripe. We do not store card details.
- We may change prices at any time, but changes will not affect an order already accepted.
- You are responsible for any bank charges or currency conversion fees applied by your card issuer.
5. Your responsibilities
- Keep your login credentials confidential and do not share seats beyond the number your plan allows.
- Ensure the information you provide to us is accurate and kept up to date.
- Use the software lawfully and in accordance with our Acceptable Use Policy.
- Maintain your own copies of business-critical data where appropriate.
6. Our responsibilities
We will provide the software with reasonable skill and care, aim for high availability, apply security updates promptly and provide support at the level included in your plan. We do not guarantee uninterrupted or error-free operation, and planned maintenance may occasionally be required.
7. Intellectual property
All intellectual property in the software, this website and our documentation belongs to us or our licensors. Your licence grants you the right to use the software for your own business purposes. You retain all rights in the content and data you create within your workspace.
8. Suspension and termination
We may suspend or terminate access where payment fails, where the Acceptable Use Policy is breached, or where required by law. Except in cases of serious misuse, we will give you notice and a reasonable opportunity to put the matter right, and we will allow you to export your data.
9. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded. Subject to that, our total liability arising from your use of the software is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for loss of profit, loss of business, or indirect or consequential loss.
10. Consumer rights
If you purchase as a consumer rather than for business purposes, you retain your statutory rights under UK consumer law, including rights relating to digital content. Nothing in these terms affects those rights.
11. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
